RISK WARNING AND WAIVER OF LIABILITY

RISK WARNING

Judo is a recreational activity that involves an obvious and significant risk of physical harm.

It is a contact sport involving throwing techniques, grappling, holds, arm locks, and strangulation techniques (with restrictions applied by age group and experience). These techniques can cause physical injury to both the person performing the throw and the person being thrown.

By choosing to participate in judo, you do so with the full understanding and acceptance that there is a significant risk of physical injury, which may include, but is not limited to, bruising, sprains, dislocations, fractures, concussion, or more serious injury.

You are encouraged to consult your medical practitioner before commencing any form of physical training or contact sport such as judo.

ACKNOWLEDGEMENT OF RISK AND WAIVER OF CLAIMS

By participating, you agree that it is an essential term of Bushido Judo Club Canley Vale (the “Club”) and its officers, servants, agents, or instructors accepting you, your child, or a person under your legal responsibility as:

(i) a member,

(ii) a temporary member, or

(iii) a visitor

and providing permission for participation in its judo classes, that you agree, on your own behalf or on behalf of your child or person under your legal care, to:

1. Waive, release, and forever discharge Bushido Judo Club Canley Vale and/or its officers, servants, agents, and instructors from all claims, demands, causes of action, or liabilities (including those based on negligence) that may arise out of, or in connection with, any injury, loss, or damage sustained while participating in judo activities or related events conducted by the Club.

2. Acknowledge and accept that participation is at your own risk or at the risk of your child or person under your legal care, and that you voluntarily assume full responsibility for any injury or damages incurred.

3. Understand that Bushido Judo Club Canley Vale provides instruction under the guidelines of Judo Australia and Judo NSW; however, no form of insurance or guarantee is provided against injury or loss. Participants are encouraged to maintain their own private health insurance and ambulance cover.

HEALTH AND SAFETY DECLARATION

You confirm that:

You or your child are physically and medically fit to participate in judo.

You have disclosed to the Club any medical conditions, injuries, or limitations that may affect safe participation.

You agree to immediately notify instructors of any injury, discomfort, or unsafe condition that occurs during training.

You consent to first aid or emergency medical treatment being provided by a qualified person if deemed necessary during any class or event.

PHOTOGRAPHY AND MEDIA CONSENT (Optional Clause)

By participating, you consent to Bushido Judo Club Canley Vale using photographs or video recordings of training, competitions, or events for promotional, educational, or social media purposes.

If you do not wish to be included, please notify the Club in writing prior to participation.

CHILDREN AND LEGAL RESPONSIBILITY

Where the participant is under the age of 18, or under a legal disability affecting their capacity to enter into a contract, the parent or legal guardian acknowledges and accepts full responsibility on behalf of the child.

You confirm that:

You have read and understood this risk warning and waiver.

You consent to your child’s participation in all judo activities conducted by Bushido Judo Club Canley Vale.

You indemnify Bushido Judo Club Canley Vale, its officers, servants, agents, and instructors against any claim or liability that may arise from the participation of your child or person under your legal care.

INDEMNITY

You agree to indemnify and hold harmless Bushido Judo Club Canley Vale, its officers, servants, agents, and instructors from and against any and all claims, demands, or causes of action (including legal costs) that may arise out of, or result from, your participation or the participation of your child in any activity conducted by the Club.

GENERAL AGREEMENT

You acknowledge that:

You have read and understood this document in full.

You understand that this waiver is a condition of participation.

You are signing this waiver voluntarily and not under duress.

This waiver remains valid for all future participation unless revoked in writing.
